REGULATIONS
Using the Free Wi-Fi Poznań wireless city network

§1. Definitions

1. Free Wi-Fi Poznań - computer network with wireless internet access, made available by The City of Poznań in the whole area of the city
2. User - individual using the Free Wi-Fi Poznań network
3. Provider - Poznań City Council with its headquarters on Plac Kolegiacki 17, 61-841 Poznań
4. Terminal - User's device for connecting to the Free Wi-Fi Poznań network (e.g. laptop, tablet, smartphone etc.)
5. Wi-FI Hotspot- places where devices are installed which enable access to the Free Wi-Fi Poznań network.
6. Radio Coverage Area - the area in which connecting to the Free Wi-Fi Poznań wireless network is possible.

§2. Scope and Purpose

1. The Provider is making the  Free Wi-Fi Poznań network available to Users for the purpose of using information services, electronic government services and the internet according to the following guidelines:
   a) The Free Wi-Fi Poznań network is provided free of charge, is non-commercial and is available only in the Radio Coverage Area,
   b) Free Wi-Fi Poznań is a wireless network with open access,
   c) Free Wi-Fi Poznań works according to IEEE 802.11 technical standards

§3. Restrictions

1. Access to the Free Wi-Fi Poznań network is limited according to space, time and the technical parameters of the connection.
2. The provider reserves the right to:
   a) impose restrictions on connection times, bandwidth, transmission of data and other transmission parameters,
   b) restrict and block access to selected content and services on the internet
   c) record, monitor and archive information and data for the purpose of ensuring security and managing Free Wi-Fi Poznań.   

§4. Exemptions from liability

1. The Provider, its employees, associates and any other entities performing work in its name, are in no way responsible for:
   a) the technical conditions of the free Wi-Fi Poznan network and internet delays  which may affect the actual transfer of data to and from the Terminal,
   b) the unauthorized use of software or other items protected by  intellectual property laws related to content available on the Internet,
   c) damage caused by Users' software,
   d) data gathered or transmitted by the User
   e) damage that may be incurred as a result of a User's use of Free Wi-Fi Poznan, in particular:
   i. damage to IT equipment, software and data as well as violation of personal data,
   ii. delays in receiving or transmitting data due to lack of transmission, incorrect transmission, delays or interruptions in access to Free Wi-Fi Poznan,
   iii. the security of operations carried out via the Free Wi-Fi Poznan network, including purchases, financial transactions, etc,
2. The Provider does not guarantee:
   a) continuous radio signal coverage in the Radio Coverage Area
   b) consistency of bandwidth and other bandwidth parameters,
   c) the continuous, proper functioning of Free Wi-Fi Poznań,
   d) the availability of all network services and Internet applications

§5. User liability

1. The Free Wi-Fi Poznań network is used at the sole risk and responsibility of the User.
2. The User may use the Free Wi-Fi Poznań under the condition that he/she reads and accepts the terms and conditions contained in these regulations.
3. The User may not use the Free Wi-Fi Poznan network for any activity which violates the law, in particular:
   a) sharing and downloading copyrighted material (software, movies, music, etc.), and content that violates the law (racist, fascist, etc.),
   b) uploading and sharing content that may infringe upon anyone's personal interests,
   c) sending advertisements (known as spam)which are unsolicited by the recipients of the content,
   d) distributing computer viruses and other programs that may damage the software or data of other Internet users,
   e) gaining unauthorized access to system resources held by other Internet users,
   f) using peer to peer (P2P) applications
   g) trying to breach the safeguards applied to the Free Wi-Fi Poznan network
4. Users may not use the Free Wi-Fi Poznań network for:
   a) running server services on the Terminal,
   b) conducting commercial activities without the knowledge and approval of the Provider,
   c) conducting any other activity that may be considered as destabilizing or hazardous to the functioning of Free Wi-Fi Poznan,
   d) sharing the Internet connection with other entities via the use of telecommunication devices such as hotspots, routers, etc.
5. In the event of failure to comply with the provisions of these Bylaws, or misuse of Free Wi-Fi Poznan, the Provider reserves the right to block access to the network.
6. The User is responsible for exercising due diligence in protecting the terminal against unauthorized access and other IT security threats (e.g. viruses, spam etc.).
7. The User is solely responsible for the manner in which he/she uses Free Wi-Fi Poznań, including content and the content of messages sent with regard to criminal liability for illegal activities.

§6. General provisions

1. In matters not covered by these Regulations, the provisions of the Civil Code apply.
2. The Provider will publish a list of the Areas of Radio Coverage on the website www.wireless.poznan.pl
3. Any changes to these regulations shall come into effect upon their publication on the website www.wireless.poznan.pl.
4. Changes to the technical parameters of the Free Wi-Fi Poznan network do not affect these regulations and do not require prior notification.
5. Ignorance of the regulations does not absolve the User of liability.
6. The Provider reserves the right to make changes to these regulations.
7. The User has no legal claim by virtue of any changes made
8. These Regulations come into force on 01.06.2012.
